1. Definitions and Interpretations
The Thyroid Clinic: refers to the company. Therein “company”, “us”, “we”, “our”,” website”, “site”;
You: refers to you, the user of Our Website and related services and/or products. Therein “you”, “your”, “user”, “client”, “patient”, “costumer’;
Terms: refers to these terms and conditions. Therein “terms and conditions”, “Ts&Cs”, “T&C”, “conditions”, “conditions of use”, “service conditions”, “service terms”, “agreement”;
Services/Products: refers to the services/products offered by the company (thyroid specialist consultations) and other thyroid and medical related services/products. Therein “medical consultation”, “thyroid consultation”, “medical appointment”, “GP appointment”, “thyroid specialist consultation”, “thyroid specialist appointment”, “virtual consultation”, “virtual appointment”, “face-to-face consultation”, “face-to-face appointment” “testing kit”, “our services”, “our products”;
Platforms: refers to the group of technologies and devices through which The Thyroid Clinic can be accessed. These include but are not limited to websites, mobile and tablet apps and other platforms. Therein “platforms’, “devices”, “website”;
Practitioner refers to the professional delivering the Services. Therein “doctor”, “dr”, “thyroid specialist”, “GP”;
2. Changes to Terms and Conditions
We reserve the right to amend, update, and make changes to these Terms at our discretion at any time. We will publish the revised Conditions of use should they be amended, and you will be deemed to have accepted the newly updated/revised Terms once they are published. Should you not agree to these Terms then you should not use our Services or Platforms.
3. Governing Law and Dispute Resolution
The Agreement shall be governed by English Law. Any dispute under this Agreement shall be submitted to the exclusive jurisdiction of English courts.
4.1 Except where otherwise agreed in writing, fees of the Services shall be due and payable by the Client at the time of the booking of the appointment, or immediately following the provision of the Services.
4.2 Fees shall be payable by the Client for the provision of such Services.
5.1 The Thyroid Clinic allows you to connect (either face-to-face, virtually [online, telephone]) to a Practitioner. The Practitioner is registered with the UK General Medical Council (www.gmc-uk.org) (‘GMC’) and is an independent medical professional. Our Platform and Services are available to you if you are in the United Kingdom (i.e. England, Wales, Scotland and Northern Ireland). We do not represent that any content available on or through the Platform is appropriate for use or available outside the United Kingdom.
5.2 The services provided are the following: book an appointment for an online/face-to-face/telephone consultation with a Practitioner via the Platform; obtain qualified and professional medical advice from the Practitioner and related administrative services including referrals and blood tests; and if agreed with the Practitioner during the appointment you may also obtain prescriptions for certain medication(s).
Please note that The Thyroid Clinic is NOT to be used in an EMERGENCY situation. You should dial 999 immediately if you believe that you or the person you are assisting is in an urgent or emergecy situation.YOU SHOULD CALL 999 IMMEDIATELY in a critical or life-threatening situation, such as if someone has: difficulty breathing; severe bleeding and it can’t be stopped; severe chest pain; a severe allergic reaction; severe burns or scalds; loss of consciousness; major trauma such as the result of a serious road traffic accident, a stabbing, a shooting, a fall from height or a serious head injury; or acute confused states and fits which aren’t stopping, or if you believe someone is having a heart attack or stroke.
7.1 Appointments are subject to availability. Appointment times are subject to change and are only made available to you at our sole discretion.
7.2 In the event that: you require medical advice and you are unable to access The Thyroid Clinic for whatever reason; there are no Appointments available to suit your requirements; you miss an Appointment for whatever reason; you lose connection to the Platform during an Appointment; or your Appointment is cancelled, including as a result of a Practitioner being unavailable, it is your sole responsibility to either book an alternative Appointment with us or seek appropriate alternative medical advice from alternative service providers (e.g. your NHS GP practice if you are registered with one).
8. Prescriptions & Letters
8.1 Prescriptions will only be issued by Practitioners where it is appropriate, legal and responsible in the circumstances and as the result of discussion and mutual agreement between you and the Practitioner.
8.2 To request a prescription or letter, you must do it during your consultation with the Practitioner. This is the only means of requesting a prescription or letter.
8.3 You understand and accept that the Practitioner, at their sole discretion, creates prescriptions, and letters based on their own professional judgement and legal obligations. You understand and accept that the content of such items is individual, based on information you provide to the Practitioner and your presentation at the time of your consultation. As such, the contents of any prescription, and letters may vary; the precise nature of the content shall be at the sole discretion of the Practitioner and you agree to hold harmless The Thyroid Clinic from any claim that may arise as a result of the contents of such items. You must not tamper with the content of any such prescriptions, or letters (to do so would be a criminal offence). You understand and accept that there is no guarantee that such prescriptions and/or letters will contain the content you desired, hoped for, expected, were informed of, understood or believed they would contain.
8.4 If you lose a prescription or letter, a copy of the relevant document may be issued, subject to the prescribing Practitioner agreeing to re-issue the document. You understand and accept that there is no guarantee that a Practitioner will agree to re-issue any document. In the event that the Practitioner re-issues your lost prescription or letter, you understand and accept you will be charged in accordance with the current cost for a prescription.
8.5 You understand and accept there is no guarantee whatsoever that you will be issued or provided with a prescription for any medication. You understand and accept that the issuing of any prescription is at the sole discretion of the Practitioner. Any reference to a ‘prescription’ shall be deemed to apply to repeat prescriptions where applicable. Any prescription that you receive is only valid for use at legal UK pharmacies. You understand and agree that any prescriptions we issue are solely for your personal use. You agree to carefully read all information provided to you and to follow the instructions provided by the Practitioner, on the prescription itself/themselves and the instructions on the label applied by the pharmacy prior to taking any of the prescribed medicines. You also agree to contact a Practitioner, another doctor or a pharmacist if you have any questions about prescribed medicines or do not fully understand the reasons you have been prescribed any prescribed medicine or the instructions related to the prescribed medicine. The Thyroid Clinic and the Practitioner are not responsible for any legal prescriptions provided to you that legal UK Pharmacies refuse to dispense. You accept that it remains an individual Pharmacist’s right to refuse to fulfil any prescription and/or dispense medications when presented with a legal prescription.
No statement, description, information, condition or recommendation contained in any Company price list, website, advertisement or communication or made verbally by representatives of the Company shall be construed to vary in any way any of the terms of this Agreement. All other warranties (express or implied) are hereby excluded to maximum extent permitted by applicable law.
10.1 The Client can move or cancel their appointment free of charge providing the request is made more than 24 hours prior to the appointment.
10.2 The Client shall be charged 100% fee of their appointment price if they will not show up/attend their appointment.
10.3 The Client shall be charged 100% fee of their appointment price for any cancellation made within the 24 hours prior to their appointment.
10.4 A 50% cancellation fee shall be issued to the Client in the event that he/she moves their appointment time and/or date. This will be applicable should the Client reschedule their appointment the same day they cancel it.
10.5 We reserve the right to refuse to reschedule or re-book your missed/cancelled appointment or any follow up appointments should the client fail to settle the chargeable fees for such appointments.
10.6 We reserve the right to keep the money of any pre-paid appointment shall the Client be charged by the Practitioner for any fees for late cancellations/missed appointments.
10.7 In the case of extenuating circumstances, a client may appeal cancellation charges by submitting a Cancellation Appeal email to email@example.com. A decision on the outcome of a client’s appeal may take up to 10 working days.
10.8 We reserve the right to delay/cancel your appointment with reasonable notice for unforeseen circumstances which are beyond reasonable control. These include but are not limited to software malfunction, health/family related problems from the Practitioner, strikes, pandemics, epidemics, extreme weather, act of terrorism, riot, government action, war, accident, lock-out, explosion, fire.
11. Limitations and Exclusions of Liability
Subject to these Terms, you will be responsible and liable to us for all actions, claims, proceedings, costs, damages, losses, and expenses(including, without limitation, legal fees) incurred by us arising out of or in any way connected with your use of our Services or Platforms or breach of these Terms.
